Preliminary Site Assessment

The Preliminary Site Assessments were used to obtain a “No Further Action (NFA)” determination from the New Jersey Department of Environmental Protection (NJDEP) under the Site Remediation and Industrial Site Recovery Act (ISRA) programs for commercial and industrial sites and operations.

Since May 2009 the state new law is known as the New Jersey Site Remediation Reform Act (SRRA) requires hiring a Licensed Site Remediation Professional (LSRP) to obtain a Response Action Outcome (RAO) determination for the site.

In 2004, New Jersey promulgated regulations requiring the environmental evaluation of Child Care Centers. Now Child Care Centers and/or educational facilities in New Jersey are subject to the “Madden Legislation” and must conduct an environmental review at the minimum, a Preliminary Assessment (PA) in accordance with the Technical Requirements.

According to the NJDEP’s Technical Requirements for Preliminary Assessment (7:26E-3.1), the person responsible for conducting the remediation shall conduct a preliminary assessment when that person:

  • Is required to submit a completed Industrial Site Recovery Act General Information Notice to the Department pursuant to the Industrial Site Recovery Act, N.J.S.A. 13:1K-6 et seq., and its implementing rules at N.J.A.C. 7:26B;
  • Wants a final remediation document for the entire site;
  • Is remediating a site or portion of a site for use as a child care center, or use as a public school, private school, or charter school;
  • Is conducting an evaluation of a child care center pursuant to the Department of Community of Affairs Act, N.J.S.A. 52:27D-130.4, and the Manual of Requirements for Child Care Centers, N.J.A.C. 10:122-5.2(i), as part of the license application or renewal for the child care center; or
  • Is ordered to do so by a court or the Department.
